Wage Laws and Overtime Pay

The Fair Labor Standards Act (FLSA) is a federal statute that governs wage standards, including required compensation for overtime pay. The law requires that most employees must be paid 1.5 times the employee's regular rate of pay for every hour per week over 40 hours. However, there are some exceptions. Employees in certain industries and with certain job responsibilities may not be entitled to overtime pay under the FLSA.

However, many employers do not understand the wage and hour requirements of the FLSA. As a result, many employers falsely classify employees as exempt (no overtime pay requirement) who should be non-exempt. In some cases, employers knowingly misclassify employees in an attempt to save money.

Other ways that employers cheat employees out of overtime pay include:

  • Forcing employees to work during meal and rest breaks
  • Failure to pay for off-the-clock work
  • Scheduling employees for more work than they can handle in a 40 hour week
  • Requiring employees to show up early for work or stay late to perform work duties
  • Classifying workers as independent contractors who should be classified as employees
