Understanding the Fair Labor Standards Act

Employees in Missouri and throughout the country have rights. Many of those rights were granted to them by the enactment of the Fair Labor Standards Act in 1938. If you suspect that your rights as an employee have been violated, you could benefit from a better understanding of the Fair Labor Standards Act.

The FLSA governs employee rights in several different areas, including:

  • Minimum wage
  • Overtime pay
  • Hours worked
  • Recordkeeping
  • Child labor

Since 2009, federal minimum wage has been set at $7.25 per hour. Some states and municipalities have chosen to increase the minimum wage in their jurisdictions. If you believe that you are not being paid at least minimum wage, you may have the right to pursue a wage-and-hour claim against your employer for violating the FLSA.

Overtime pay must be paid to non-exempt employees when they work more than 40 hours per week, and the pay must be equal to or greater than one and a half times the employee's standard hourly pay rate. Workers who believe they are not receiving the overtime they deserve due to misclassification or illegal recordkeeping practices may find they have legal options thanks to the FLSA.

Regardless of the area of the FLSA's coverage into which your complaint falls, you can learn more about your legal options by discussing your situation with an experienced employment law attorney. Attorneys with experience representing the interests of Missouri employees who have suffered rights violations can explain your rights under the Fair Labor Standards Act. In addition, those legal professionals can also guide you through the process of filing a claim against your employer.
